Hi,
I need advice for licensing a library of drum kit
audio samples. The following is a list of objectives:
1. free as in beer and speech useage and distribution
of the library for commercial and non-commercial
interests but the orginal copyright statement must
remain intact.
2. distribtuion of modified versions of the library is
strictly prohibited. Adding samples to the library or
changing the sound of any sample constitutes a
modification. I will accept contributions for
inclusion but the owner would have to share copyright.
3. derivitive products in the form of songs, sound
tracks or any other product can be freely distributed
but must include a credit to the effect of Drum
samples from "Mirror Image Drum Sample Library
copyright Ron Parker".
An example album credit could appear similar to the
following:
Album Title
Artist
Songs:
1. Free Beer written by Josephine Doe, drum samples
(MI), bass guitar John Doe, etc.
2. Free Speech written by John Doe, drum samples
(MI)... ...

I'm trying to find a specific license that exactly
covers my interests. Maybe it's a Creative Commons
license. The biggest problem is I don't have alot of
time to think about or research the licensing issues.
I'm not sure if restricting modification of the
library would prevent it from being included in Debian
distributions. Any thoughts on that? I appreciate all
help and advice.

You can use CC licences to cover most possibilities. Attribution is
taken as a given with the version 2 licences. The only problem is
that CC licences are very lengthy and lawyeristic (the 'legal code'),
although there is a summary you can provide for users (the 'commons
deed').
Try this one for starters:

However, Debian does have a mechanism for 'non-free' packages.

I don't think they would be right for Ron, as they permit 'creative
transformation'. They also have a restriction on use in advertising,
which is pretty vague. I guess that's because TV adverts can make
more money for artists than their records do...

Yes, although you can add a 'non-free' apt-get source.

This is why lawyers make so much money - first, you write a licence...
I'd argue that the use of drum samples 'as is' in a program like
Hydrogen doesn't constitute transformation of the samples themselves.
It becomes complicated when you add real-time effects, since the
effects aren't printed to the samples, yet the modified form will
appear on the recording. I guess it's the distribution of modified
drum samples, not the modification itself, that's the issue.
My personal principle is that licences on creative tools - which would
include authorised drum kit samples included with software -
shouldn't be applied to the creative works made with those tools.
That really would be a 'viral' effect, and a restriction on user
freedom.
