I think all your points are wrong:
1) There is currently no valid patent issues with
Linux. So there is no
issues to be resolved either.

I bet there are many things in Linux (and any other OS) that are covered
by
MS Patents.
Software patents aren't (yet, and maybe they will never be) recognized by
law in all countries. Maybe Singapore doesn't too. And if they do right
now, they could change their minds if they get threatened by Microsoft for
stupid double click patents and such.
