From what I've heard, the big commercial studios are overly conservative
about rights, and willingly pay for even incidental use of a song, which
some would argue is clearly under 'fair use'. I have a friend who is
getting regular checks for a song that was playing on the jukebox in the
next room while the actor was making a phone call. It's all of 30
seconds, and you have to concentrate on ignoring the primary action and
dialog in order to recognize the song, but the studio is gladly writing
checks. Go for it!
