Certainly not. If they chose to use the GPL at one time, further developing a
GPL version from the last fully GPL version is perfectly proper. It is one of
the main reasons to USE GPL softwqre in the first place. The right to fork is
important.
I could say more to the other angle, but will refrain at this point.
