you dont need a patched kernel. (for more than 2 years now)
you just need a proper pam setup.
Not every distribution uses PAM. Slackware doesn't - maybe Puppy doesn't either.
then patch the login program or use the rlimit command ?
gentoo took a really long to time to update to the required pam version.
during that time, my login shell was somthing like: rlimit -r 99 bash
