I didn't read the whole digest, anyway, as others mentioned before, it's a cloudy
situation.
I guess you don't sample, but e.g. plays a sequence.
1. Is there any copyright on the scale?
2. Is anybody able to hear the quoted sequence?
3. Is the one you'll quote a moneymaker or a musician? Yes, Metallica will sue you,
Musicians don't care, they feel flattered.
4. Do you make money with this quote?
5. By random several people have the same idea at the same time, maybe "random"
is morphogenetic.
6. By random we very often unintended quote or simply have got the same idea.
DON'T CARE ABOUT IT!
7. What is the situation if you modify the quote? E.g. a different phrasing? Or if the
phrasing is important, exchange blue-notes and regular scale notes. At what point the
quote will become a new composition?
8. Blame guys like Eric Clapton for stealing simple phrases, IIRC one of "his"
songs of that kind is "man overboard".
IMO its ok to quote, what ever the law says. It only became shameful, if the whole song is
a qouote and praised as a self-made opus.

Well I think I'll quote from the main theme and it's important to quote from
THIS PIECE and hopefully make it recogniseable, if short. So I do go the
official channel. But I'm not too worried. We'll see, otherwise I'll have to
think of something else. :-)

For sure you don't quote a mainstream, millenium moneymaker, but a musician. Quotation
is wanted. Some dinos became musicians, because there parents (at least one of them was/)
were moneymakers ;). Generalisation? NO! Just brutal truth ;).
Since I know you from off-list discussions, I'll put my shirt on you "heißt
hoffentlich das ich "meine Hand für Dich ins Feuer legen kann"", that you
don't have "evil designs".
Regarding to vanity I re-composed songs I wrote, that make me feel, that I might have
stolen an idea. The term for doing this is "obsessional neurosis". Hehehe, I
like obsession, I like ethics, BUT DON'T CARE ABOUT QUOTATION. Just a thought! Is it
possible to get in contact with the composer? If not, are you planing world domination?
Music, is music, is music ;).
You are allowed to do what's good for music. No artist cares about the written laws.
Ethic is the only rule. C'mon you aren't anti-ethically. Don't waste your time
with this thought, I did much to often and rewrote songs ... stupid me!!!

Hello again my friend!
In this case I will make the effort. I usually just play my own music or use
Bach. Everything else is accidental. But I'd much rather have that in order.
Besides, whatever you may think about musicians: They are humans too, so they
span the complete horizon from kindly minded people, to bad mouthed bastards.
:-) And there are the record labels as well. :-) So that's the end of that.
